The September 26th affair

The other day I was blogging about how I had received spam from a company (A), and how that company had used another company (B) as their address source, and how the e-mail demonstrably has been sent from a server that belongs to company (C). I am not a customer of any of these companies, and I have not agreed to receiving any information from them. Because of that I am of the opinion that these three Sweden-based companies are breaching the Marketing Act”s nineteenth paragraph:

19 § En näringsidkare får vid marknadsföring till en fysisk person använda elektronisk post, telefax eller sådana uppringningsautomater eller andra liknande automatiska system för individuell kommunikation som inte betjänas av någon enskild, bara om den fysiska personen har samtyckt till det på förhand.

This is what my post from 26th of September originally was about. The original text is no longer there, since I received a call from a person representing company C, where he threatened with reporting me to the police and telling my manager that I was discrediting his company, and that this caused him to lose money.

That might very well be, but I stand by my position that there has been a breach of the nineteenth paragraph of the Swedish Marketing Act, since I have neither agreed to nor is interested in advertisements from the companies in question. I have reported the spam letter to the Swedish Consumer Agency, but I have neither contacted companies A, B nor C about the issue, since I have bad experiences with doing so, when I have done it with other companies, it has just led to increased amounts of spam and no action has been taken.

For clarity, I am including one of the spam letters in its entirety below, so that those who are interested can decide for themselves:

Man kan ju fundera hur mycket utbildning vederbörande har när han säger "Är borta från Google inom trettio minuter". Vilket kräk!

Jag blir så irriterad. Du borde polisanmäla dem. Eller ringa och prata med deras chef -men det var kanske han som ringde- och förklara ett och annat om vett och etikett.

Jag tycker att du skall stå på dig. Du har skrivit på din privata blogg. Även om du hade begått något fel, så har din arbetsgivare inte med det att göra, och det borde gå att förklara för arbetsgivaren. Snarare är det så, att om de börjar trakassera dig eller din arbetsgivare gör de sig skyldiga till fler brott.

Jag måste säga att att döma av responsen från XY är de sannolikt inte seriösa, hur mycket de än bedyrar det.
